TERMS & CONDITIONS

General Conditions: All package rates, information and taxes are subject to change without notice. Prices are not guaranteed until the reservation is paid in full and you receive a confirmation. Keka’s Travel reserves the right to re-invoice your reservation should an error be made in computing your package price. Adjustments made to the package pricing will not be made once full payment has been applied, nor will any subsequent rate reductions be made retroactive. Prices are based on specific days of travel and are subject to limited availability. Prices may vary based on the actual date of travel, class of service or hotel booked. Government-imposed airline ticket excise taxes are in effect at time of electronic posting. We reserve the right to amend these rules and restrictions at any time without notice.

Suppliers: Some of the services that you reserve and purchase through Keka’s Travel Agency are being provided to you directly by the supplier of those services (‘Supplier’) and not by Keka’s Travel. A Supplier is an airline, hotel, car Rental Company, or other provider of services of a particular Keka’s Travel item or component. In addition to the Terms and Conditions contained in the Agreement, your purchases and reservations are also governed by the terms and conditions of the respective Suppliers.
Any claims that you may have with regard to the goods and services purchased or reserved through our Agency will be addressed to the Supplier.

Fees: A fee may be incorporated in the total price of a Keka’s Travel package for arranging, facilitating and processing your purchases. You agree to abide by the terms and conditions set by the Supplier, including, but not limited to, observation of check-in/check- out times and compliance with all rules and conditions related to rates, products, or services.

Payments: Payment in full is required to receive a confirmation. American Express, MasterCard, Discover, Visa or Cash payments are accepted. The credit card selected for payment will be charged for the total price of the reservation. If payment is withdrawn through credit card chargeback, the Operator shall be entitled to recover reasonable collection fees, attorney fees, and any other costs associated with recovering the full package price. Such fees commonly add a minimum of 30% to the payment amount due on the booking. If payment is withdrawn prior to travel for any reason, the Operator has the right to cancel the trip. The address requested is the billing address of the credit card that must be issued to a U.S. or Canadian billing/mailing address and issued by a U.S. or Canadian based bank. The cardholder must be a traveler listed on the reservation. To provide confirmation of authorized card use, you may be required by the supplier to present a credit card at time of check-in, rental or pick up.

Refunds/Revisions: All purchases made are nonrefundable, unchangeable and non-transferable, including but not limited to, names changes, hotel choice, and cancellations due to changes in travel plans, flight delays, early check out of hotel and no shows. For all cancellations, we require proper notification. Penalties and refunds will be subjected to “Suppliers” term and conditions on each particular case. Cancellations MUST be phoned into Keka’s Travel Agency at 1-800- 593-5352. No refunds will be made for unused, partially used or complimentary components.

Not Included: Rates do not include Passenger Facility Charges where applicable. Gratuities, meals (unless otherwise noted), rollaway and/or crib charges, and guest incidentals at hotel, parking, or ticket media (unless purchased as an option). Destination Departure Tax, Security Surcharge, Customs Fees, Federal Inspection Fees, APHIS fee, and general cost of passports and visas and other such fees where required depending on destination selected. Please contact our Service Desk for specific taxes and/or
fees not included.

Identification: U.S citizens, 18 years or older, are required to show government issued photo I.D. Acceptable forms of identifications include the following: Valid Driver’s License, Military I.D., and Valid Passport. Non-U.S Citizens who are residing in the U.S should carry their passport, green cards and any other document required for their U.S. residency. Children under the age of 18 traveling with an adult are not required to show I.D at time of check-in.

ENTRY REQUIREMENTS: Bermuda and Mexico: Valid passport or government issued photo I.D. and a county or state-issued original copy of birth certificate or notarized copy of county or state-issued birth certificate. Caribbean and Bahamas: Valid passport or a government issued photo I.D. with an original or
certified copy of birth certificate with a raised seal. Canada: U.S. citizens without valid passports can obtain entry to Canada with a certified birth certificate and a government issued photo I.D. or an expired passport. Brazil: Passport and Visa are required. Chile: U.S citizens must have a passport that is valid for 6 months beyond intended stay. Europe: U.S. citizens must have a passport that is valid for six months upon return to the U.S. Non-U.S. citizens must contact the nearest consulate in the countries being visited for specific entry/visa requirements. When traveling outside the United States, it is your responsibility to obtain the required documentation. We strongly suggest that you verify the entry requirements with the visiting country’s consulate office prior to departure. Passenger(s) without proper identification may be denied boarding. Minors under 18 years of age traveling to Mexico, Brazil and Chile: Must have a notarized letter of consent that has a valid period of 30 days and is good for a single entry.

If traveling unaccompanied: A notarized letter of permission (originals only) signed by both parents and an individual passport. If traveling with only one parent: A notarized letter of permission (originals only) signed by the other parent.
In case of deceased or divorced parents: Legal proof must be submitted to accept only one parent’s signature on the notarized letter of permission in order to establish that signing parent has legal custody of the minor.

Special Request: If you have special requests (such as aisle seats, handicap, floor location, view, non-smoking room, etc.), you must inform us before your reservation is confirmed. Each request will be subject to availability. No reservation may be canceled based on the failure of a Supplier to satisfy special requests.

Hotel: Your name and reservation information has been communicated to the hotel. You may be required to present a credit card at time of hotel-check. Hotel amenities are at the discretion of the hotel and are subject to change without notice. Hotel photos are representative only and do not necessarily depict the actual room in which guests will be accommodated. Minimum age restrictions may apply for hotel check-in.

Rental Car Restrictions: Length of contract and car type varies depending upon destination selected. Taxes and other government-imposed or authorized charges, fuel, optional collision damage waiver, airport-imposed taxes/fees, overtime and drop off charges, additional driver or young renter’s fee, and
other optional items, if any, are extra. Rates are higher for renters under age 25. Some airports impose a tax or fee, ranging up to 10% if you choose to exit on shuttle bus. Minimum rental charge is one day (24-hour period). A one-way rental charge may be applied if a rental is not returned to the city where it originated. Minimum age for renting a car is twenty-one (21) years, except where state law provides otherwise. Renters must have a valid driver’s license and major credit card in their name. Renters without a major credit card in their name must meet the cash rental requirements. Most major credit cards are accepted and billed at the time of rental. A credit card deposit or cash deposit is required. Cash deposit needs to be 140% of the complete rental period for Avis and $50 per day, with a maximum of $200 per week for Alamo.

Currency: If your vacation is taking you outside the United States, it is advisable to exchange some money prior to travel. Local banks, American Express, and AAA offices can issue travelers checks in foreign currency. Once in the destination country, you can exchange money at the airport, banks,

American Express offices, and most hotels. Keep in mind that each time you exchange money; you will be charged a fee. Therefore, to cut down on conversion fees, you should limit the number of times you change money. You can completely avoid these fees by using your credit cards to make purchases. Foreign currency rates fluctuate daily.

Baggage: For baggage policies please visit the airline’s website directly. Baggage policy may vary depending on your destination and fare regulations.

E-tickets: Since your vacation has been electronically ticketed you should have received an e-Document. With Electronic (E-ticket) all you need is your e-Document and government issued photo I.D. or passport depending on travel destinations requirements. Simply present identification and/or proof of citizenship to receive a boarding pass.

Confirmation: Please reconfirm your flights 48 hours prior to departure, both on the departure and the return by calling the airline directly or at our Office 1-800- 593-5352. You are also advised to arrive at the airport at least 2 hours prior to your departure. In the event of a delay or cancellation, the airline is solely responsible for determining and providing compensation in the event any is due. All passenger air transportation is subject to the terms and conditions of the tariffs, contracts of carriage, rules, regulations, policies, terms and conditions (including Warsaw Convention notices) of the operating airline.
Security: Due to heightened security at the airports, only ticketed airline passengers will be allowed through security checkpoints.

Schedule Changes: Regular scheduled flights, scheduled for airlines in the Computer Reservation System have been selected for the vacation package; however, Keka’s Travel will not be held responsible for any airline changes that result in an increase in airfare or deviation in original flight itinerary. TAXES AND FEES EXTRA

Vacation Protection Plan: Allows travelers to cancel their vacation with the guarantee of a refund of the package price less the cost of the policy. Certain non-refundable components are only covered in the event you need to cancel for a covered reason such as illness, injury or death. This plan also provides additional coverage for trip interruption, trip delay, medical protection, baggage protection and worldwide emergency assistance. Certain limited medical coverage and additional benefits are also included. Reduction to the number of persons traveling or changes made to dates, hotel, ground or air

transportation are considered revisions and will not be protected by the Vacation Protection Plan. We strongly suggest you to ask our Agent about these plans.

EUROPE INFORMATION:
Passports: A valid passport is required. If you are traveling on a non-U.S. passport, please check with the appropriate consulate for entry and/or visa requirements. It is your responsibility to obtain the required documents. Contact our Agent for further information and appropriate consulates. 1-800- 593-5352.

Possible Changes in Service: if a Supplier notifies us of changes in a service, we will use our good faith efforts to notify you. If a change in the service occurs within 24 hours of the scheduled flight, hotel, or car reservation, we will use our good faith efforts to notify you of the changes by phone. Notification of changes occurring more than 24 hours before the scheduled reservation will be by e-mail. Keka’s Travel is not liable for any changes in the reservation that are beyond our control and are caused by, due to, or are attributable to the Supplier. Keka’s Travel will not be responsible for any additional expenses incurred due to a change in service.

Keka’s Travel Customer Satisfaction Pledge: Your satisfaction is very important to us. That’s why we give you our utmost assurance that we will stand by our product to ensure you have a fulfilling vacation experience. Therefore, if any tangible component of any Keka’s Travel package is not delivered as described in your travel documents (except under circumstances beyond the reasonable control of the tour operator), we will refund the value of the undelivered component plus issue a travel credit which may be used for future Keka’s Travel packages, provided proper documentation of the claim is received within 30 days after completion of your Keka’s Travel package. This warranty is in lieu of all other warranties. We make no other warranties or representations of any kind, express or implied, arising by law or otherwise, including without limitation any implied warranty of merchantability or fitness for a
particular purpose, or any implied warranty arising from course of performance, course of dealing, or usage of trade. Claims must be postmarked and submitted to:

WITHIN 30 DAYS AFTER COMPLETION OF YOUR VACATION.

Responsibility: Keka’s Travel packages are operated by Certified Companies, (the “Operator”) as independent contractors and not as an agent, employee, partner, or joint venture of Keka’s Travel Agency. Keka’s Travel is not liable for any claim of any nature arising out of or in connection with air or other transportation, services, or other features, performed or occurring in connection with any tour, other than as provided in the contract of carriage governing Keka’s Travel provision of air transportation in conjunction with these vacation packages. The tour services described in your documents, including without limitation transportation, lodging, and sightseeing, are provided by carriers, hoteliers, and other suppliers that are independent contractors and not the agents, employees, partners, or joint ventures of the Operator or Keka’s Travel. The Operator issues tickets, vouchers and other travel documents for such services merely as an agent for the companies that furnish such services.

Other: Such tickets, vouchers, and other travel documents are subject to all terms and conditions of the respective suppliers (some of which may limit or exclude the supplier’s liability). The Operator is not responsible for typographical and/or printing errors. Neither the Operator nor Keka’s Travel Agency, nor any subagent of either of them, shall be responsible for any loss of or damage to property or death or injury to person, resulting from any act or omission of any supplier providing any tour service or any other person or entity or caused by strike, war, weather, quarantine, sickness, government restriction or regulation, or any other cause beyond its reasonable control. The tour participant expressly waives all rights which he or she may have against the Operator in connection with the foregoing. These terms and conditions are governed by Florida law without regard to principles of conflict of law. Jurisdiction for any
action relating to any Keka’s Travel Vacation package shall be in Miami-Dade County, Florida. Under no circumstances is the Operator to be construed as a carrier under contract for safe carriage of the passengers or his or her baggage and belongings.
